GENERAL TERMS AND CONDITIONS OF SALE

The customer acknowledges having read and accepted the general terms and conditions of sale set out below. By confirming your order by clicking on "confirm my order", you agree to these terms without reservation.

Article 2: Scope and Application of the Terms

These terms apply to the sale of products by LA CAVE INSOLENTE through its online store. They are available to the buyer on the homepage of the website lacaveinsolente.com.

By clicking on "General Terms and Conditions of Sale" (hereinafter referred to as "T&Cs"), the customer may review the applicable terms before proceeding with their purchase. Therefore, placing an order constitutes full and unconditional acceptance of these T&Cs.

Failure of the seller to invoke any of these terms at any given time shall not be considered as a waiver to enforce those same rights later.

Article 3: Prices

Prices are displayed in euros (€), all taxes included (VAT), excluding shipping costs. Subject to typographical or display errors. Payment is required at the time of ordering.

For deliveries within mainland France and Corsica: prices include VAT and French duties.

For deliveries within the EU or to other countries: shipping fees, customs duties, and any other applicable formalities are the sole responsibility of the customer. Taxes, if applicable, are to be paid to the delivery service.

LA CAVE INSOLENTE reserves the right to modify its prices at any time. However, the price displayed at the time of order confirmation will be the one charged.

Article 4: Product Availability

If your order cannot be fulfilled in sufficient quantity, you will be informed by email or phone within 24 hours. If you agree, the remaining items will be shipped later at our expense within a timeframe communicated by email. Otherwise, a refund will be issued by bank transfer within 48 hours upon receiving your request (via email, phone, or post).

Article 5: Delivery

Conditions

Products are delivered to the address provided by the customer. Parcels are shipped via our usual carrier or a service provider of our choice.
The customer must check the condition of the packaging and the contents upon delivery, and compare the quantity and references received with the order confirmation. Signing the delivery receipt constitutes acceptance.

If a parcel arrives damaged (e.g., broken bottles), the recipient must record the damage on the delivery slip, stating the name of the damaged item, and refuse the damaged goods. The carrier will inform LA CAVE INSOLENTE. Upon notification, a replacement parcel will be sent at no extra cost. Under no circumstances will refunds for the product or shipping be granted in this case.

Delivery Times

Delivery times depend on the shipping method and the delivery location and begin once payment is received.

Unforeseen Circumstances

We are not liable for loss, damage, delay, or failed delivery resulting from events beyond our control, including (but not limited to):

Force majeure

earthquakes, storms, floods, war, road/train/plane accidents, embargoes, strikes.

Issues related to the nature of the shipment, even if known to us.

Acts or negligence of third parties

carriers, customs officers, postal services, or any third party involved in the delivery process.

Electrical or magnetic interference or damage to electronic or photographic images/data.

Quality Degradation During Shipping

LA CAVE INSOLENTE is not liable for any quality deterioration of the products or packaging during transportation. We do not replace or refund wines that are corked, leaking, or otherwise defective due to the wine’s intrinsic nature. By purchasing, the customer accepts this possibility.

Unclaimed Packages

If a package is returned due to non-collection (e.g., from a pickup point), it can be reshipped once the customer pays the actual reshipping costs.

Liability

Products are shipped at the customer’s own risk. It is the customer's responsibility to check the parcel contents and report any issues.

Insurance

Insurance costs are included in the shipping fees, unless otherwise stated.

Article 6: Payment

General Terms


All orders must be paid in full at the time of ordering via:

- Secure credit card payment
- PayPal
- ApplePay

Once payment is received, your order will be dispatched along with the final invoice (unless billing and delivery addresses differ, e.g., for gifts).

Secure Payment by Credit Card

We use secure encryption technology to protect your online payments.

PayPal

Select PayPal as your payment method to be redirected to the PayPal platform, where you can log in and complete payment.

Article 7: Returns

In accordance with Article L121-16 of the French Consumer Code, you have 7 working days (extended to 14 days as of June 14, 2014, per the Hamon Law) to exercise your right of withdrawal without providing a reason or incurring penalties (return shipping costs excluded). This period starts upon receipt of your order. If the last day falls on a weekend or public holiday, the deadline is extended to the next working day.

Products must be returned in good condition, in original packaging, and accompanied by the original invoice. Your purchase will be refunded within 15 days of receipt of the returned goods.

Return shipping costs are only covered by LA CAVE INSOLENTE in the event of a mistake on our part. Please contact customer service for return instructions.

Article 8: Dispute Resolution

All contractual provisions above are governed by French law.

Our Customer Service team is available to resolve any disputes. Failing an amicable resolution, the courts of Nîmes, France will have exclusive jurisdiction.

For EU countries (excluding Denmark), Regulation (EC) No. 861/2007 of the European Parliament and of the Council of 11 July 2007 will apply.

Computer records stored in our systems under reasonable conditions will be considered valid proof of communications, orders, and payments between parties.

Article 9: Protection of Minors

Under French law (Ordinance No. 59-107 of 7 January 1959 and Law No. 74-631 of 5 July 1974), it is prohibited to sell or offer alcohol to minors. By placing an order, you confirm that you have the legal capacity to enter into a contract.

Article 10: Account Deactivation

If a customer violates any of these terms, fails to pay for an order, provides false information, or engages in actions detrimental to LA CAVE INSOLENTE, we reserve the right to suspend or terminate their account and/or subscription without compensation.

We may also refuse to do business with any customer previously excluded for such reasons.

These terms are subject to change. The applicable version is the one in effect on the date the order is placed.
